Not a medical service. Anticipa is a wellness and self-management tool — not a substitute for professional mental health diagnosis, treatment, or crisis intervention. If you are in immediate danger or crisis, call 911 or the Suicide & Crisis Lifeline at 988.

Acceptance of Terms

By accessing or using Anticipa ("Service", "App"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. These Terms constitute a legally binding agreement between you and Anticipa Health, Inc. ("Anticipa", "we", "us", "our").

If you do not agree to these Terms, you must not access or use the Service. Continued use of the Service after any modification to these Terms constitutes your acceptance of the updated Terms.

You must be at least 13 years of age to use Anticipa. Users under 18 should have parental or guardian consent. By using the Service, you represent that you meet these age requirements.

Description of Service

Anticipa is a proactive mental wellness platform that uses AI to help users anticipate anxiety triggers, track emotional patterns, and access evidence-based coping tools. The Service includes:

Anxiety forecasting based on user-inputted schedule and event data
AI-powered coping coach and personalized recommendations
Guided grounding, breathing, and somatic exercises
CBT Thought Log and cognitive reframing tools (Pro)
Exposure ladder therapy tool (Pro)
Smart journal with AI pattern detection
Panic SOS emergency protocol
Cloud sync for data across devices (registered users)

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

Not Medical Advice

The Service is intended for general wellness and self-management purposes only. Nothing in the Service constitutes medical advice, diagnosis, or treatment. Anticipa is not a licensed medical provider, and the AI-generated responses are not a substitute for advice from a licensed mental health professional.

Anticipa is not a covered entity under the Health Insurance Portability and Accountability Act (HIPAA). Do not use the Service as your sole source of mental health support.

If you are experiencing a mental health crisis, suicidal thoughts, or are in immediate danger, call 911 or the Suicide & Crisis Lifeline at 988.

User Responsibilities

By using the Service, you agree to:

Provide accurate information when creating your account
Keep your login credentials secure and confidential
Use the Service only for personal, non-commercial wellness purposes
Not attempt to reverse-engineer, scrape, decompile, or exploit the Service
Not use automated tools, bots, or scripts to access the Service
Not use the Service to harm yourself or others
Not violate any applicable laws or regulations in your use of the Service

You are responsible for all activity that occurs under your account. You must notify us immediately at [email protected] if you suspect unauthorized access to your account.

Pro Subscription & Billing

iOS In-App Purchase (App Store)

If you subscribe to Anticipa Pro through the Apple App Store, your subscription is managed by Apple. Billing, cancellation, and refunds are governed by Apple's Media Services Terms & Conditions and Apple's standard cancellation policy. To cancel, go to Settings > Apple ID > Subscriptions on your iOS device.

Web Subscription (PayPal)

If you subscribe through our website, Pro plans are available monthly ($3.99/mo) or annually ($31.99/yr). Charges are processed at the start of each billing period via PayPal. Prices may change with 30 days' advance notice.

Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period — you retain Pro access for the remainder of the paid period. No partial refunds are issued for unused time, except where required by applicable law.

Free Trial

Where offered, free trials automatically convert to paid subscriptions at the end of the trial period. Cancel before the trial ends to avoid charges. Trial eligibility is determined at Anticipa's discretion.

Refunds

For App Store purchases, refund requests must be submitted to Apple. For web purchases, contact [email protected] within 7 days of charge for refund consideration. Refunds are at our discretion and subject to applicable consumer protection laws.

Intellectual Property

All content, features, functionality, software, design, text, graphics, logos, and user interface elements of the Service are the exclusive property of Anticipa Health, Inc. and are protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes. This license does not include the right to sublicense, copy, modify, sell, or create derivative works of the Service or any of its components.

User-generated content you submit (such as journal entries and event data) remains your property. By submitting content, you grant Anticipa a limited license to store and process it solely to provide the Service to you.

Privacy & Data

Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in the Privacy Policy.

You may request deletion of your account and all associated data by emailing [email protected] with the subject "Delete my account". We will process deletion within 30 days.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee the accuracy, completeness, or usefulness of any AI-generated content, forecasts, or recommendations.

Use of the Service is at your sole risk. This disclaimer applies to the fullest extent permitted by applicable law.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ANTICIPA HEALTH, INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES — ARISING FROM:

Your access to or use of (or inability to access or use) the Service
Any conduct or content of third parties on the Service
Any AI-generated recommendation or forecast that proves inaccurate
Unauthorized access, use, or alteration of your data

Our total liability to you for any claim arising from the use of the Service shall not exceed the greater of (a) $100 USD or (b) the total amount you paid to Anticipa in the 12 months preceding the claim.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms or engaged in conduct that could harm Anticipa, other users, or third parties.

You may terminate your account at any time by contacting [email protected]. Upon termination, your right to use the Service immediately ceases. Sections of these Terms that by their nature should survive termination will do so, including intellectual property provisions, disclaimers, and limitations of liability.

Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or the Service shall first be attempted to be resolved informally by contacting us at [email protected]. We will try to resolve disputes within 30 days of receiving written notice.

If informal resolution fails, disputes shall be submitted to binding arbitration in Delaware under the rules of the American Arbitration Association (AAA), except that either party may seek injunctive or equitable relief in a court of competent jurisdiction. You waive any right to participate in a class-action lawsuit or class-wide arbitration.

If you are a consumer in the European Union, you may also contact your local consumer protection authority or use the EU Online Dispute Resolution platform.

Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and, where required by law, provide additional notice (such as an in-app notification or email).

Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.
